§1. Educational tool disclaimer

SMC ChartSense is a research and backtesting tool for self-directed crypto traders. It allows you to backtest your own configured strategy ideas, receive walk-forward analysis verdicts, and monitor strategy performance on live data.

It is not a trading service. We do not provide buy/sell recommendations, curated picks, push notifications of "today's trades," or any form of personalised trading advice. Every strategy run on this platform is configured by you, tested with your parameters, and monitored on your own account.

All output — including walk-forward verdicts (ROBUST / MARGINAL / CURVE-FIT), profit factor, win rate, and Strategy Monitor event logs — is informational analysis intended for educational purposes only.

§2. Not investment advice

Nothing displayed, calculated, or generated by SMC ChartSense constitutes investment advice, financial advice, trading recommendation, or solicitation to buy or sell any asset. Any decision to trade or invest is solely yours, made at your own risk, with your own capital, and based on your own analysis.

§3. No profitability guarantee

We make no claim, warranty, or representation that any strategy tested on this platform will be profitable. In fact, our walk-forward methodology is specifically designed to expose strategies that look profitable in backtest but fail out-of-sample.

Most strategies fail walk-forward. If you test many configurations and none produce a ROBUST verdict, that is a valid and valuable result — it may save you from losing significant capital on a curve-fit strategy that appears profitable but isn't.

Studies of retail CFD/forex traders show 70-95% lose money. The retail crypto space is likely similar or worse. We built this platform around that honest reality. Subscribers pay for honest backtesting infrastructure — not for guaranteed profitable strategies.

§4. SEBI registration status

SMC ChartSense and its author are not registered with the Securities and Exchange Board of India (SEBI) as Research Analysts, Investment Advisers, or any other regulated category. We do not provide services that would require such registration.

SMC ChartSense operates as a technology platform in the same legal category as other widely-used charting, backtesting, and strategy-analytics platforms — providing tools for self-directed traders to configure and monitor their own strategies. We do not broadcast trading picks, publish premium signal feeds, or offer personalised advisory services.

If you require regulated investment advice, please consult a SEBI-registered Investment Adviser. We are not one.

§5. Data sources & limitations

Market data is fetched from Binance Futures (USDT-margined perpetuals) via their public API. Data accuracy depends on Binance's data integrity; we display data as-received without modification beyond standard cleanup (deduplication, format normalisation).

Our walk-forward methodology and Strategy Monitor depend on this data being consistent and available. Service interruptions due to Binance API outages, rate limits, or data gaps are outside our control. We make reasonable efforts to handle such situations gracefully but cannot guarantee uninterrupted service.

Backtest results reflect commission & modelled slippage, but cannot perfectly replicate live trading conditions. Real live trading will involve order-fill delays, partial fills, larger-than-modelled slippage during high volatility, and exchange-specific quirks. Live performance is typically worse than backtest performance — sometimes substantially.

§6. Refund policy

7-day satisfaction guarantee

If you are unhappy with Backtest Pro within 7 days of your initial purchase, we offer a full refund — provided you have run fewer than 5 backtests during that period. Email support@smcchartsense.com with your purchase email and we will process the refund within 5 business days.

Refund-eligible reasons

• Platform bugs or service unavailability preventing meaningful use
• Accidental duplicate purchases
• Charged after subscription cancellation (we'll refund and audit)
• Service unavailable for more than 24 consecutive hours during your billing period
• Within the 7-day satisfaction window with minimal use (under 5 backtests)

NOT refund-eligible reasons

• You did not find a profitable trading strategy. Backtest Pro is a backtesting tool, not a profitability guarantee. Many users discover their configured strategies don't have a robust edge — that is valuable information and exactly what the tool is built to reveal. The service is delivered the moment you receive walk-forward verdicts and Strategy Monitor events on your strategies.
• You lost money in live trading after using our platform. We don't provide trading advice (see §2). Live trading decisions are yours alone. Our analysis is informational only, and our disclaimer explicitly states past performance doesn't predict future results.
• You disagree with our walk-forward verdict on your strategy. Verdicts are computed by transparent methodology applied identically for all users.
• You changed your mind after the 7-day window. Subscription is ongoing — cancel anytime via Gumroad to stop future charges (see §7), but past billing periods are not refunded.
• You cancelled an Annual plan mid-period. Annual plans are already discounted 25% vs Monthly. We do not pro-rate refunds on annual purchases. You retain access until the annual period ends.

§7. Subscription & cancellation

Subscriptions are managed by Gumroad. You can cancel anytime by visiting your Gumroad library.

• Backtest Pro Monthly ($9.99/mo): cancel anytime. You retain access until the end of your current billing period. No further charges occur.
• Backtest Pro Annual ($89.99/year): cancel anytime. You retain access until the end of your annual period. No further charges occur. Cancellation does not trigger a refund of the unused portion.

After your access expires, you can re-subscribe at any time. Existing data (run history, Strategy Monitors with their event logs) is retained for at least 12 months after subscription expiry — re-subscribing within that window restores access to it.

We store: your email (for login), your subscription tier (for feature gating), your backtest runs and their parameters (so you can review them later), and your Strategy Monitor event logs (so you can compare live performance to backtest).

We do not store payment information (Gumroad handles all payment processing). We do not sell user data to third parties. We do not run ads.

You may request export or deletion of your data by emailing support@smcchartsense.com.

§10. Policy changes

We may update this policy from time to time. The "Effective" date at the top of this page reflects the most recent change. Material changes affecting paying subscribers will be communicated via email at least 14 days in advance.

Continued use of the service after a policy update constitutes acceptance of the updated terms.
